Ending a Mississippi tenancy
A Mississippi residential lease with a definite term expires on the date in the agreement. Without a definite term, weekly rent generally creates a week-to-week tenancy that needs at least seven days' written termination notice; other ordinary periodic tenancies are month-to-month and need at least thirty days' written notice. The agreement's renewal and notice terms must be checked. Miss. Code §§ 89-8-17(1), 89-8-19(1)-(3)
Read the lease for a definite end date and renewal clause.
Weekly rent without a definite term ordinarily means week-to-week tenancy.
Other nondefinite residential tenancies ordinarily use the thirty-day month-to-month rule.
If the tenant stays after termination, continue to the holdover path.
What happens next
The workflow separates a fixed-term expiry from a periodic termination notice. A tenant who remains after an established end date moves to the holdover analysis.
