North Dakota Unpaid Rent: 3-Day Notice and Eviction Next Steps

North Dakota's nonpayment process has two timing gates. Rent must first remain unpaid for three days after it is due, then the landlord uses a written 3-Day Notice of Intention to Evict before filing. For nonpayment only, the current North Dakota court packet uses a demand for rent or possession.

  • Failure to pay rent becomes an eviction ground after rent remains unpaid for three days after it is due.
  • For subsection 4 cases, § 47-32-02 requires a written three-day Notice of Intention to Evict before filing.
  • For nonpayment only, North Dakota's current self-help packet uses a demand for rent or possession.

Built around the requirements of N.D.C.C. §§ 47-32-01(4), 47-32-02.

How is the 3-day deadline counted?

North Dakota's June 2026 court instructions apply Rule 6: start the day after service, count three calendar days including weekends and state holidays, and move the deadline to the next non-weekend/non-holiday day if Day 3 lands on one.

How can the notice be served?

The court packet allows personal service through the county sheriff or by another adult age 18 or older who is not a party to or interested in the eviction. Posting is available only after the required unsuccessful service attempt and must be done by the sheriff or a process server.

What happens after the notice?

If the tenant does not comply and the supported prerequisites remain satisfied, the landlord may begin an eviction action in the North Dakota District Court for the county where the rental property is located.

Common mistakes to avoid

Serving before the rent has remained unpaid for the required three days.
Counting the day of service as Day 1.
Using landlord self-posting instead of the statutory sheriff/process-server posting route.
Treating the notice as permission for self-help removal.

Frequently asked questions

Does North Dakota give the tenant a chance to pay?

For an eviction based only on nonpayment or late payment, the current North Dakota court packet uses a Notice of Intention to Evict that gives the tenant three days to pay the full amount due or move out.

Do weekends count?

Yes in the middle of the three-day period. If Day 3 is a Saturday, Sunday, or North Dakota legal holiday, the deadline rolls forward.

Can an LLC owner represent itself?

No. North Dakota's court instructions state that a nonlawyer cannot represent a legal entity in an eviction.
