What Happens After a Texas Lease Violation Notice Expires?

A notice period expiring does not automatically mean the landlord should file an eviction. Before moving to Justice Court, recheck cure, possession, termination rights, the Chapter 24 deadline, delivery proof, retaliation, special housing, mixed grounds, and any other stop condition.

Built from the frozen Texas lease-violation 2026 rule set, verified August 25, 2026.

The rule to remember

Expiration of the notice period is only one checkpoint.

The landlord should file only after confirming that possession is still being withheld, the termination basis still exists, every required cure or response step was satisfied, the Notice-to-Vacate period actually expired under the correct start fact and counting rule, and no unresolved legal overlay requires review.

Before filing, recheck these six questions

Did the tenant cure?

If cure was required and the tenant timely cured the same breach, stop the uncured-breach pathway unless another independent termination basis exists.

Did the tenant move out?

If possession was surrendered, do not treat the possession case as though nothing changed merely because the notice period expired.

Does the termination basis still exist?

Confirm the lease or legal basis for ending possession still applies to the current facts and has not been waived, superseded, or resolved.

Did the Notice-to-Vacate period actually expire?

Recheck the lease-specific §24.005 period, the supportable delivery/start fact, and §24.0042 counting before relying on a filing date.

Is delivery supportable?

Preserve the notice, method, date, tracking or receipt evidence, electronic records, witness notes, and any separate §92.012 mailing proof.

Is there a stop condition?

Retaliation, subsidized or program housing, manufactured-home rules, mixed nonpayment and lease-violation grounds, specialized statutes, or disputed facts can require a different path or individualized review.

If the tenant cured, do not skip over that fact

Where the lease or another governing rule made cure a prerequisite to termination, a timely cure can change the landlord's ability to rely on the original uncured-breach theory. The product should not automatically move from “notice expired” to “file eviction” without asking what happened during the cure period.

If cure is disputed, incomplete, temporary, or the conduct later recurred, the actual lease language and evidence matter. That is a review question rather than a reason to assume that every repeated event has the same legal consequence.

Do not file from the calendar alone

A calendar can tell you when a correctly identified Chapter 24 period ends. It cannot determine whether the landlord had a present right to terminate possession, whether the tenant cured, whether delivery is supportable, whether §92.012 was satisfied, or whether retaliation or a program rule changes the case.

Recheck the Notice-to-Vacate period and delivery together

Notice period

Texas Property Code §24.005 generally defaults to at least three days for a tenant who defaults, but a written lease or agreement may provide a shorter or longer period.

Once the correct period is identified, Chapter 24 counting follows §24.0042.

Review the deadline rules →

Delivery/start fact

The filing date depends on a supportable Chapter 24 delivery or receipt fact. Do not automatically use the mailing date merely because the notice was mailed.

Also check the separate §92.012 primary-residence mailing requirement when it applies.

Review the delivery rules →

Retaliation and special housing can stop the ordinary path

Texas Property Code §§92.331-92.332 create a retaliation framework that should be checked when recent protected tenant activity exists. A claimed lease violation should not cause the product to skip that review.

Section 8, public housing, HUD, HOME, or another subsidized or program tenancy may have additional notice, response, termination, or federal requirements. Manufactured-home tenancies and violation-specific statutory schemes can also require a different process.

Mixed nonpayment and lease-violation cases should not be forced into the ordinary lease-violation pathway because the 2026 nonpayment rules can change the required notice analysis.

If the case passes the recheck, can the landlord file?

If the landlord's right to possession has terminated, the tenant remains in possession, the applicable Chapter 24 notice period has expired, delivery is supportable, and no unresolved stop condition applies, the next stage is a forcible-detainer case in Justice Court.

  • Venue: §24.0041 places the case in the Justice Court precinct where the property is located.
  • Petition: the landlord should state the facts and grounds for eviction and when and how the pre-suit notice was delivered.
  • Evidence: preserve the lease clause, addenda or rules, cure notice if any, cure-status evidence, Notice to Vacate, delivery proof, photographs, communications, incident records, and other evidence supporting the alleged breach and termination theory.

Before Justice Court, preserve the complete file

  • Lease and incorporated documents. Keep the clause, addendum, or rule the landlord relies on.
  • Violation evidence. Preserve photographs, video, complaints, communications, witness information, reports, and incident records as appropriate.
  • Cure history. Keep any warning/cure notice, delivery proof, response, and evidence showing whether the breach was or was not cured.
  • Termination and Notice-to-Vacate records. Preserve the exact notice, delivery evidence, §92.012 mailing proof if applicable, and deadline computation.
  • Later events. Record move-out, cure, waiver, new violations, payments relevant to mixed grounds, or other facts that changed after notice.

Texas after-lease-violation-notice FAQ

Can a Texas landlord file eviction as soon as a lease-violation notice expires?

Not automatically. Before filing, the landlord should confirm that the tenant remains in possession, every required cure or response process was completed, the landlord still has a present termination basis, the Chapter 24 Notice-to-Vacate period actually expired, delivery is supportable, and no retaliation, special-housing, mixed-ground, or other stop condition requires review.

What if the tenant cured the lease violation?

If cure was a prerequisite to termination and the tenant timely cured the same breach, the uncured-breach pathway should stop unless another independent termination basis exists. The lease language and facts still control.

What if the tenant moved out after the Notice to Vacate?

If the tenant surrendered possession, the possession issue may be resolved. The landlord should not treat an eviction-for-possession pathway as unchanged merely because a notice period expired.

What if the Texas Notice to Vacate was mailed?

The landlord should not assume that the mailing date automatically became the Chapter 24 delivery/start date. S.B. 38 repealed the former statutory deemed-delivery rule, so the supportable delivery or receipt fact should be resolved before relying on the filing date.

Where is a Texas eviction for a lease violation filed?

Texas Property Code §24.0041 places forcible-detainer venue in the Justice Court precinct in which the real property is located. The petition should state the facts and grounds for eviction and when and how the required pre-suit notice was delivered.
