Oklahoma Unpaid Rent: Five-Day Demand and Court Next Steps
For an ordinary Oklahoma residential rental, a landlord may terminate for unpaid rent if the tenant fails to pay within five days after a written payment demand. The rent demand is also a demand for possession, so § 131(B) does not require another notice to quit on that ground. Possession still requires court process.
- The ordinary residential payment demand is five days under § 131(B).
- Reconcile rent, credits, agreement conditions, and asserted essential-services defenses.
- Substituted service under § 111(E) depends on unsuccessful personal and family delivery.
Built around the requirements of 41 O.S. § 131(B).
What amount belongs in the demand?
Use the actual agreement and ledger after payments and credits. Tracy-Herald Corp. v. Jones upheld a demand that also included lease late fees; it did not make every charge recoverable. This generator states base rent only, and disputed or additional charges require review.
How are the five days counted?
Section 61 excludes the first day and includes intermediate Saturdays, Sundays, and holidays. If the final day is a legal holiday under 25 O.S. § 82.1, extend to the next nonholiday day. The governor's designated holidays can vary by year.
How is written notice delivered?
Section 111(E) first calls for personal service. If the tenant cannot be located, delivery may be to a family member over twelve residing with the tenant. If neither is possible, conspicuous posting must be paired with certified mail or USPS Firm Mailing Book for Accountable Mail.
What happens after the demand?
Reassess payment, defenses, service, and special protections. An unresolved possession claim proceeds under Title 12's forcible-entry-and-detainer rules in District Court. Keep the notice and service evidence; do not use self-help.

Frequently asked questions

Section 131(B) treats the past-due rent demand as a demand for possession and does not require another notice to quit on that ground.
Do weekends count in an Oklahoma five-day rent demand?
